Terms of Service

Welcome to Premier Air Conditioning & Refrigeration, Inc. ("we", "us", or "our"). These Terms of Service (“Terms”) govern your use of our website and the services we provide. By submitting a service request, scheduling an appointment, or otherwise engaging with us, you agree to be bound by the following Terms.

1. Scope of Agreement
These Terms and Conditions apply to all services, quotes, and products provided by Premier Air Conditioning. Any additional or conflicting terms submitted by the customer (“you” or “Customer”) are expressly rejected unless otherwise agreed to in writing. If a separate signed agreement exists, that agreement will govern.

2. Quotes and Pricing

  • All quotes are valid for 15 days unless otherwise stated.

  • Due to ongoing changes in materials, labor, and supply chain conditions, prices are subject to change at the time of contract signing.

  • A non-refundable 50% deposit is required to initiate service unless otherwise stated.

  • Any additions, changes, or unforeseen conditions will result in additional charges.

  • A 4% surcharge applies to all credit card payments.

3. Payment Terms

  • Payment terms are Net 15 or Net 30 based on written agreement.

  • Invoices not paid within the agreed term will incur 1.5% monthly interest (18% annually).

  • You are responsible for all legal fees, court costs, and collection expenses incurred due to nonpayment.

  • Premier AC may stop work or withhold materials if payment is delayed.

4. Communication Consent
By submitting a service request, you agree that we may contact you using the phone number or email provided to:

  • Confirm appointments

  • Send reminders or invoices

  • Follow up on your service

  • Provide marketing updates (you may opt out at any time)

 

 

5. Service Conditions

  • Work will be performed during standard business hours (9 AM – 5 PM, Mon–Fri).

  • Work outside these hours may be billed at 30% higher rates.

  • You must provide clear, safe access to equipment and work areas.

  • Our technicians may refuse service if conditions are deemed unsafe.

6. Installations, Repairs, & Maintenance

  • Installation quotes are based on current site conditions; unforeseen issues may result in additional costs.

  • Customer is responsible for acquiring permits unless otherwise agreed.

  • Repairs may require diagnostics and are quoted based on known issues.

  • Maintenance services include inspection, cleaning, and testing. This does not guarantee prevention of failure.

  • Emergency or after-hours services may incur extra fees.

  • Warranty on repairs and maintenance ranges from 30–90 days; workmanship warranties typically cover 1 year.

7. Permits and Compliance
You are responsible for ensuring compliance with zoning, building codes, and HOA regulations. We assume no liability for violations unless specified in writing. Additional code compliance work not included in the original estimate will be billed accordingly.

8. Warranties

  • We warrant that our work will be performed in a professional and workmanlike manner.

  • Warranty is void if payment is not made in full, if equipment is misused, or if others tamper with our installation.

  • Equipment warranties are provided by manufacturers.

  • All warranty work is performed during normal business hours and subject to technician availability.

 

9. Limitations of Liability

  • We are not liable for damage to existing equipment, property, utilities, landscaping, or structures unless caused by our gross negligence.

  • We are not responsible for mold, pre-existing conditions, or damage caused by natural disasters.

  • We are not liable for indirect or consequential damages under any circumstances.

 

10. Customer Responsibilities

  • Provide accurate information for scheduling and permitting.

  • Maintain equipment in line with manufacturer recommendations.

  • Secure pets and children during service visits.

  • Notify us in writing of any service issue within 48 hours of completion.

 

11. Cancellations and Rescheduling

  • Appointments must be canceled or rescheduled at least 24 hours in advance.

  • Late cancellations may be subject to a service fee.

  • Custom-ordered parts are non-refundable once ordered.

 

12. Dispute Resolution and Legal Venue
Any disputes arising under these Terms shall be resolved in the courts of Miami-Dade County, Florida. These Terms are governed by the laws of the State of Florida.

13. Severability
If any provision of these Terms is found unenforceable, the remainder shall remain in effect.

14. Changes to These Terms
We reserve the right to update these Terms at any time. Updates will be posted on our website with the revised effective date.
